Situation
We were asked to jointly assist several insurers who were Defendants in a Supreme Court proceeding. Each defendant was represented by a separate legal team. The Defendants expected to receive a large volume of incoming discovery from the Plaintiff that they would all need to review. However, whilst those documents would be common to all parties each defendant intended to review those documents using a different workflow and for a slightly different set of issues. Each party also had data from their respective clients that needed to be kept separate from all other parties.
Solution
Due to the differing nature of the data and each party’s approach to the common dataset it was not feasible to run a joint database to support their review work. Instead, we were able to facilitate a workflow that provided individual workspaces to each defendant and assigned an individual consultant to each party through a commercial multi-party model that made financial sense to their respective end-clients.

This solution allowed our clients to:
Manage the security of their client’s documents and the review of the common documents in an efficient and cost-effective manner without reducing the speed with which they can undertake that work
Engage in their own independent review workflows with timely assistance from their dedicated expert team
Provide a commercial solution to their end-client that was better than individually engaging separate eDiscovery service providers
