Situation
Our client was working on a large construction dispute involving more than 10 million electronic documents. Using various eDiscovery workflows, we assisted our client to narrow down the review set to just under one million documents. Our client had to review these documents with reference to over 30 categories and issues, with only eight months to complete this review. With reference to our client’s legal team and their relevant capacity, we calculated that this review would take well over a year to complete.
Solution
Our review management experts worked closely with the legal team to source a capable external provider of experienced legal reviewers. We helped to select a provider with specific experience working in construction arbitration and on large scale document reviews. Our team worked with our end-client to develop a review workflow that limited duplication of review effort whilst ensuring accuracy and consistency of review work product. This workflow was a mixture of human and technical processes with layers of quality assurance checks throughout. There was a particular focus on having our client’s legal team review complex and/or high-risk documents (relevant to certain categories, inconsistent/complex coding decisions or involving redactions). This workflow was then executed through a combined effort from the legal team, Sky Discovery’s review managers and the external review team, of which there were 100 people involved.
Impact

Facilitated the review of close to one million documents within three months, well in advance of the deadline
Ensured accuracy of review was high as the burden of review was spread amongst many and quality control mechanisms put in place to reduce inconsistency
Reduced the financial burden on our client’s client as only the high value and complex work was undertaken by our client’s legal team
Allowed our client’s legal team the time to progress other aspects of the matter (outside of the review) and other matters they were working on more broadly
