Using eDiscovery beyond discovery/disclosure

There are extensive uses for eDiscovery processes outside the usual discovery and disclosure preparation. The utility extends beyond dispute resolution to any legal environment in which electronic documents need to be reviewed by a lawyer. In these circumstances it is not a matter of if the technology can help, but a matter of how. You should engage your eDiscovery partner to understand the ways in which they might be able to assist you.

Consider

  • Chronologies: Many eDiscovery platforms can build a chronology within the review workspace, linking critical documents to critical events. This chronology can be exported and hyperlinked, for use by the legal team, their experts, the Court, or any other interested stakeholders.

  • Evidence preparation: Documents that are included in a witness statement, affidavit, expert report, or other form of evidence should always be referenced by the document ID assigned in the review workspace. The relevant document can then be identified, exported, and automatically linked to the relevant document with the appropriate document annexed or attached accordingly.

  • Electronic court books: Your eDiscovery partner can assist in preparing the documents that might be required for an electronic court book. They can prepare the export for upload to an electronic trial platform or prepare the relevant hyperlinked documentation for presentation to the court.

  • Print sets: Your eDiscovery partner can assist in preparing print ready exports of documents from the review workspace that might need to be sent to parties who prefer or require documents in hard copy.

  • Subpoena Responses: The same review workflow that applies to discovery and disclosure can be used by parties who must respond to a subpoena or other request for documents, from collection through to processing and review as well as the export of an ordered, structured, and hyperlinked response.
