Migrating an active eDiscovery project from another provider

Situation

Our client was involved in a construction arbitration with over 11TB of client data, of which 4TB was under review. They originally hired another provider for eDiscovery, but after quality issues and missed deadlines, they sought advice regarding possible migration to Sky Discovery.

The legal team was working towards very strict deadlines and had several complex workflows beginning or about to commence (document language translation and outsourced review). Due to issues with their initial eDiscovery provider, our client was at risk of non-compliance with discovery requirements agreed upon with the other party and tribunal. Any material failure to comply could have had cost implications for their client as well as strategic ramifications for their matter more broadly.

Solution

Sky Discovery worked to understand the legal team’s requirements around database access and timing to build a migration timeline that minimised the impact on the legal team’s review progress. A full database audit was completed to understand the structure and any issues with the existing database that would need to be managed throughout the migration.

Once the migration plan was finalised, the various technical and consulting elements of the migration team worked over a period of 18 days to migrate the processing review workspace of more than 11TB of data. The legal team could access their workspace in just over four days. The work associated with this migration was completed on a complimentary basis.

Impact

Our work in migrating this large active matter allowed our new client to:

  • Increase in the operational speed of the review workspace by 30%

  • Complete the translation process 10 times faster than previously estimated

  • Uncover and rectify several errors within the database that could have impacted future work

  • Remove the risk around non-compliance with discovery deadlines

  • Complete their review and comply with their obligations by the relevant deadlines
