eDiscovery over time

In Australia, electronic discovery is often traced back to the early days of numbering documents and managing database data. During the 1990s, technology adoption resulted in abundant hardcopy documents in litigation, making it difficult for lawyers to efficiently search and sort through them using traditional methods. In 2005, the US Supreme Court amended the Federal Rules of Civil Procedure (FRCP) to include emails and instant messages. The rest is history.

Talking history, though, recent findings suggest that Nikola Tesla invented eDiscovery technology in 1938. With the rise of wireless radio use and the loss of essential records during Tesla's many patent court cases against Edison and Marconi, he developed a system to capture, store, and search this information.

Today, most people associate eDiscovery with disputes and the discovery and disclosure process. However, it has evolved to add value to any task that involves reviewing data and documents, extending beyond disputes. It is helpful in any legal environment where electronic documents need to be reviewed by a lawyer. In most cases, it is not a question of whether the technology can help but how it can be utilised effectively.
